2. Account Registration

You must provide accurate registration information, be at least 18 years of age (or have the legal capacity to enter into binding agreements in your jurisdiction), and — if registering on behalf of a business — have the authority to bind that entity. You are responsible for keeping your credentials secure and for all activity under your account.

3. Free Trial

We may offer a free Trial to allow you to evaluate the Service before committing to a paid Subscription. We strongly recommend using the Trial period fully to confirm the Service meets your requirements before purchasing. If you do not upgrade, your account and data may be deleted at the end of the Trial.

4. Subscriptions and Fees

Billing: Subscription Fees are charged in advance on a monthly or annual basis as selected at purchase.

Renewal: Subscriptions automatically renew unless cancelled before the renewal date.

Price changes: We will provide at least 30 days' notice of any pricing changes. Continued use after the effective date constitutes acceptance.

Taxes: Fees are exclusive of applicable taxes. You are responsible for all taxes in your jurisdiction.

5. Refund and Cancellation Policy

What "cancellation" means: Cancelling your Subscription means you choose not to renew at the end of the current billing period. Your access continues uninterrupted until the period expires. There is no mid-period cancellation that stops the clock or triggers a partial refund.

Payment disputes (Mobile Money): If you initiate a payment dispute or claim you did not authorise a Mobile Money (MoMo) transaction, please contact us first. We maintain a full record of every payment, including the MoMo transaction ID, timestamp, amount, and associated account, which we will use to verify the transaction. Unsubstantiated chargeback requests may result in immediate suspension of your account.

Pricing changes: We reserve the right to change subscription pricing at any time. We will provide at least 30 days' written notice (via email or an in-app notification) before any price change takes effect. Your continued use of the Service after the effective date constitutes your acceptance of the new price.

Data after cancellation: You may request an export of your data within 30 days of cancellation, after which your data may be permanently deleted.

6. Acceptable Use

You are permitted to use the Service for your internal business operations.

You are not permitted to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose
• Attempt to access another customer's account or data
• Reverse engineer, decompile, or attempt to derive the source code of the Service
• Reproduce, resell, or sublicense access to the Service
• Upload malware or code intended to disrupt the Service or other users
• Use bots or automated scripts to access the Service in a way that causes disproportionate load
• Attempt to bypass any security feature or access control
• Scrape or harvest data from the Service
• Use the Service in a way that infringes the intellectual property rights of the Company or any third party

7. Your Content and Data

Ownership: You retain full ownership of all Content you submit to the Service. We do not claim ownership of your data.

Licence to us: By submitting Content, you grant us a limited, non-exclusive, royalty-free licence to store and process it solely to operate the Service.

Accuracy: You are solely responsible for the accuracy and completeness of the Content you submit. We are not liable for errors in your Content or for decisions made based on it.

8. Intellectual Property

The Service — including its design, code, user interface, features, trademarks, and all associated intellectual property — is and remains the exclusive property of Flex Analytics. Nothing in these Terms transfers any intellectual property rights to you.

9. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Service Availability and Updates

We aim to provide a reliable service but do not guarantee uninterrupted access. We may perform maintenance, modify or remove features, or discontinue parts of the Service at any time with reasonable notice.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind — express, implied, or statutory. We do not warrant that the Service will meet all your requirements, operate uninterrupted or error-free, or that results obtained will be accurate or reliable. You are solely responsible for verifying the accuracy of any data, reports, or outputs generated by the Service.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Flex Analytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our maximum aggregate liability for any claims shall not exceed the total fees paid by you in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Flex Analytics from any claims, liabilities, damages, losses, or expenses arising out of your use of the Service in violation of these Terms, your Content, your violation of any applicable law or third-party rights, or any unauthorised use of your account.

14. Termination

By you: You may terminate your account at any time by cancelling your Subscription and requesting account deletion.

By us: We may suspend or terminate your access immediately if you breach these Terms, if we suspect fraudulent or illegal activity, or if required by applicable law.

15. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall first be attempted to be resolved through good-faith negotiation before being submitted to the courts of the jurisdiction applicable to the location of Flex Analytics.

16. General

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flex Analytics.
• Severability: If any provision is unenforceable, the remaining provisions continue in full force.
• Waiver: Failure to enforce any provision shall not be deemed a waiver.
• Assignment: You may not assign your rights without our prior written consent.
